CFPB Rescinds Procedure Relating to Rulemaking Rule (12 CFR Part 1074, Subpart A)

The CFPB rescinds its 2012 procedural rule that deemed a Bureau rule issued when posted on its website or published in the Federal Register, whichever came first. Rules will instead be treated as issued under the traditional Federal Register mechanism; the change imposes no requirements on lenders or servicers and is effective June 18, 2025.

What to do

AWACS interpretation · not source language

What to review: The CFPB has removed its 2012 procedural rule on when a Bureau rule is deemed issued, effective June 18, 2025. Rules are now treated as issued under the traditional Federal Register mechanism, and the record says this imposes no requirements on lenders or servicers, so nothing is mandatory.
